Overloading Fine
The penalty for carrying beyond permitted weight, charged as a base amount plus a rate per excess tonne.
Penalties for overloading were raised substantially by the 2019 amendments to the Motor Vehicles Act. The structure is a fixed base penalty plus an additional amount for every tonne carried in excess, which means the cost escalates quickly on a seriously overloaded vehicle rather than being a flat cost of doing business.
The penalty is not the whole exposure. An overloaded vehicle is generally required to offload the excess before it may proceed, which means arranging another vehicle at the roadside, and the delay cascades into missed delivery windows and detention at the consignee. The indirect cost usually exceeds the fine.
Insurance is the risk operators most often overlook. Where a vehicle is being operated outside the conditions of its permit or registration, an insurer may resist a claim arising from an incident. A modest saving from an extra tonne is a poor trade against an uninsured accident.
